Making a contract with us

When you place an order with us, you are making an offer to buy goods. After receipt of your order we will send you an order acknowledgment email detailing the products and prices you ordered. If you do not receive such an email within one working day of placing your order please contact our Customer Service.

The order acknowledgment email is an acceptance of your order. Acceptance of your order and formation of the contract will only take place once we have confirmed your card authorisation for your order. We will send you a despatch confirmation email when the products you have ordered have left our warehouse. If your order has not been accepted you will receive an email from us telling you the reasons why.

Pricing policy

All prices shown in the website are in UK GBP. In case we use a special sale offer price please note that this might be a limited period offer which we will then indicate. The price for goods remains the same regardless of the country of delivery.

We take great care in providing you with the right product information and prices. In the unlikely case that an error in pricing appears in goods that you have ordered we will inform you as soon as possible. However we shall be under no obligation to fulfil an order for a product that was shown at an incorrect price. In such a case we will contact you by email to update or cancel the order.

Delivery charges

We ship to Germany, United Kingdom, Sweden, Netherlands, Spain, Italy, France, Belgium, Norway, Denmark and Finland.

A charge (based on the size and details of the order) will be made to cover postage and packaging on all orders sent. This charge is displayed during the checkout process. We also offer international delivery to a number of countries. All orders for international delivery are subject to international terms and conditions. See 'delivery outside UK' section.

Payment

We accept Visa, MasterCard, PayPal and other local bank debit payment methods. We take payment at the time we 'finalize' your order.

All credit card and debit card holders are subject to validity checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Description of Products and Availability

If an items sells out we will take it off display as soon as possible. If items that you order should be out of stock, or delayed for any reason, we will try to contact you, or if we receive no response to our e-mail we will continue to process the remaining items of your order.

If an offer is subject to a limited period of availability or is made subject to conditions, this will be explicitly mentioned in the offer.

Shopping, Registering as a Client and Placing an Order

We have tried to make shopping with us as easy as possible.

If you wish to place an order, select the goods and choose the specification and size you want, and press "Continue (proceed to checkout" button. This is located at the bottom of the page. When you have finished shopping, and have reviewed your order you can then enter your shipping and payment details. Check your details carefully and enter the address you want your order delivered to. After you have done this, click on the "Finalize Order" button. This starts the payment process.

Once you have placed an order, it will then be confirmed by email. Please check your order and the confirmation thoroughly. It is important that you give a correct and personal email address when you register in order to avoid errors. Please make sure that your SPAM filter does not cause you to not get our messages.

When placing an order you have agreed that these Terms and Conditions apply to such order.

Delivery

If you are not at home during the day that will not be a problem, we will deliver your order wherever you want. In this case it is important that you give the right address when placing the order.

When your order has been shipped we will send you a despatch confirmation by email. This will include a tracking number to check delivery progress.

We send the goods that you have ordered through your chosen shipping carrier. The place of delivery is deemed to be the shipping/delivery address that you provide in your order.

We aim to process your order and despatch within 1 business day of your payment clearing. Orders placed by 2:00 p.m. will normally ship that day (Mon-Fri). Delivery times may vary.

If the goods are lost or damaged in transit, please let us know promptly, so that we can make a claim against the carrier. We will offer you the choice of a replacement or a full refund. Please see Returns Policy for further details.

Cancellation and Return Policy

This cancellation policy does not affect your rights when we are at fault – for example, if goods are faulty of miss described.

Please note that goods that have been created or adapted by us in accordance with your specifications are excluded from the above rights of cancellation and/or return.

We are extremely confident that you will be pleased with your Smart Retract product; however, if you come up against some installation challenges or other issues, we're happy to help you out before resorting to a return. Often there are simple solutions to help solve many of the problems that you may run into. Simply e-mail us at info@SmartRetract.co.uk with any questions or concerns you have.

You have a legal right to cancel your contract before delivery and up to 7 working days after delivery. If you do require a return, we accept returns within 30 days of purchase.

If you cancel, you must return the goods to us at your own expense. You are responsible for the risk of loss or damage when you return goods, so you should take out enough postal insurance to cover their value.

If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.

Faulty Goods

If there is a problem with the goods please contact us to discuss the matter further.

All our products are warranted to be free from defects in materials and workmanship for a period of one year from the date of purchase to the original owner.

If the goods are found to be faulty within a reasonable time after delivery, you may reject them and claim a full refund. If the fault is found later on, or if you delay in making a complaint, you will still be entitled to a repair or, if a repair cannot be done without causing you significant inconvenience, a replacement. If a replacement is not available, you may claim a part or full refund of your money.

No claim for faulty goods can be made if any of the following applies: damage caused deliberately or negligence, improper use or careless maintenance, normal wear and tear, damage caused by not heeding, or incorrectly heeding the user/washing instructions.

Returns Process

If you do require a return, we accept returns within 30 days of purchase. Items must be clean, odor-free, and undamaged. Returns that meet these criteria are never charged a restocking fee.  Shipping is not refundable. Please e-mail customer service at info@SmartRetract.co.uk to request your Return Merchandise Authorization (RMA) number and return instructions. In your e-mail, be sure to include either your Order ID or name and address and the reason for your return. To help save the environment we do not include a paper receipt. Your Order ID can be found on the electronic receipt that was e-mailed to you the day of your order and can also be found on your shipping label.

The product(s) must be returned in the original packaging accompanied with all parts and accessories along with a note including your RMA number (also write your RMA # on the outside of the box). Once your return has been received and inspected, a credit will be given for the purchase price; normally within 1 to 2 weeks of receipt. At that time we will e-mail you a refund confirmation notice.

In the event that the wrong product has been sent to you, we will refund the amount you paid for your purchase with us including the original shipping costs. Any costs incurred on your behalf for the return of the wrong item shall also be refunded by us once we have received the goods from you.

Exchange process

The fastest way to receive your exchange would be to place a new order and then return the original. Remember that we need to receive your items within 30 days. Just email us at: info@SmartRetract.co.uk to request your Exchange RMA number and the return instructions for your exchange.

If you have already installed your mounting brackets and would like to leave them installed, that's no problem. Simply keep the product you plan to return until you receive the new one. Then take the unopened Bracket Kit from the new package and include that with the original product for return.

Ordering from outside the UK

If you order products from our UK website for delivery outside the UK, they may be subject to import duties and taxes. For other Countries please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. We will not be held liable for any delay in delivery due to parcels being held for inspection by customs.

You are responsible for ensuring that the product you have ordered can be lawfully imported into your desired country. When ordering from us, you are classed as the importer of record and must comply with all laws and regulations of the destination country. We advise you to make any necessary checks in relation to this before placing your order.

We will not be liable for any breach by you of any such laws. You agree that if any liability is incurred by us because of this you will reimburse us for any costs, damages and expenses to us in connection with any such claim.

Payment

Payment from outside of the UK may be made by any of the methods indicated on our website. Payment shall be made in UK GBP. The exchange rate will be set by your bank or credit card provider who may also charge you an additional administration fee.

Complaints Procedure

We do our utmost to provide you with the best information, products and services possible. In the case you do have a complaint or other comment to make please contact us by telephone, email or post at the earliest possibility clearly explaining the feedback you have. We will reply within 2 Days and will every effort to resolve your complaint at that time.

Except as set out above and in relation to our contractual obligations to supply goods and/or services following acceptance of orders placed on our website, neither we nor any of our agents, affiliates, directors, employees or other representatives will be liable in contract, tort, negligence or otherwise for any loss or damage whatsoever in any way connected with your use of the website.

We shall not be liable for any indirect, or consequential loss of whatever nature, including damage to software or hardware, loss of income or revenue, loss of data, damage or loss of business, loss of profits or contracts, loss of anticipated savings, waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable or any other indirect or consequential loss arising out of or in connection with your use of the website (including without limitation, any such loss arising out of or in connection with any order placed on the website, whether or not accepted by us)

Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party´s only remedy shall be for breach of contract as provided in these terms and conditions.
